Ex-justice minister Němec bags another state contract

The law firm in which Pavel Němec is a partner has won a contract worth Kč 35 million with the State Institute for Drug Control (SÚKL)

Former justice minister Pavel Němec has won another contract with a state institution. This month the law firm Němec, Bláha & Navrátilová, in which he’s a partner, won a tender to provide legal services for the State Institute for Drug Control (SÚKL). The institute estimates that the five-year contract will be worth around Kč 35 million.

The law firms Rowan Legal, Havel & Holásek and Michal Kroft in tandem with another firm, NWD Legal, submitted an offer for the contract, as did rivals PPS and Holubová advocates, a document made available to Czech Position shows. The offers were evaluated according to price — which was 60 percent of the criteria — with legal analysis of the law on public health insurance and assessment of the bidders’ response to the request for information accounting for the remaining 40 percent.

The price criterion consisted of two subcategories: the monthly flat fee for legal services of up to 20 hours accounted for 10 percent of the evaluation, and 90 percent of the price evaluation was based upon the fixed price offered for each hour over the 20 contractual hours per month.

Largest monthly flat rate, lowest hourly rate

The firm Němec, Bláha & Navrátilová asked for the highest monthly fee (Kč 92,000 as opposed to the lowest rate of Kč 19,500 offered by Michal Kroft), but offered the lowest rate for each hour above the contractual 20 hours per month (Kč 1,300 compared with Kč 1,490 offered by Michal Kroft and Kč 2,250 offered by Havel & Holásek, which was the highest).

Němec, Bláha & Navrátilová won the price criterion with 55 points, just above Michal Kroft and NWD with 52 points, while Rowan Legal scored 50 points, PPS a Holubová advocates - 43 points, and Havel & Holásek - 33 points.

Němec, Bláha & Navrátilová scored the most points in the assessment of the legal analysis submitted, with Rowan Legal coming in a close second. Having scored favorably for their price offer, Michal Kroft and NWD Legal fell well behind the competing bidders in this category.

Overall, Němec, Bláha & Navrátilová scored 95 points; Rowan Legal – 88 points; and Michal Kroft together with NWD Legal scored 68 points.

The law firm Němec, Bláha & Navrátilová has already won contracts for provision of legal service from the Ministry of Justice, Ministry of Regional Development, the Prisons Service and the state health insurer VZP. Němec and his partners’ firm also won the contract with the Road and Motorway Directorate for retrieval of unpaid road tolls. 

Pavel Němec served as justice minister from 2004 until 2006 in the governments of Stanislav Gross (Social Democrats, ČSSD) and Jiří Paroubek (ČSSD). Němec was elected as a candidate for the center party Freedom Union – Democratic Union (US-DEU), which was formally dissolved on Dec. 31, 2010.
